The term “barrier” includes a natural or constructed topographic feature that prevents children from accessing not a pool and, in the case of a spa, a lockable cover. In various methods of play, a “pool” is a sum of money made up of the stakes of different people, which are then wagered as a bet for a race, game or other competition, and the winnings (if any) are divided proportionally among the participants in the pool. Or it is a sum composed in the same way of the contributions of several people, each of whom then makes his guess or prediction about the event of a future competition or danger in order to better take the whole pool. “Agent” means a legally authorized representative of the Owner. “Spa” means a recreational or therapeutic hydrotherapy unit that is not emptied, cleaned or filled after each use. It may include, but is not limited to, units designed for the circulation of hydrojet, hot water, cold water, mineral bath, air induction bubbles or any combination thereof. General terminology for a spa includes, but is not limited to, therapeutic pool, hydrotherapy pool, spa, spa, and spa. “Pool” or “Pool” means any structure, pool chamber or reservoir located indoors or outdoors that contains an artificial body of water intended for swimming, wading pool, diving or recreational swimming, including spas and spas, and with a water depth of 24 inches or more at any time. “Public pool” means any pool or spa, other than a private residential pool or spa, that is intended to be shared by several persons for swimming or bathing and that is operated by a single person, whether as owner, lessee, operator or concessionaire, whether or not such use is subject to a fee. The term “public pool” includes, but is not limited to, tourist facilities, pools owned or operated by a condominium, private club or association of persons, dwelling or association of persons. The term “public pool” does not include insulated leg tanks and showers used exclusively for therapeutic purposes. The term “pool” or “spa” means any outdoor or indoor structure intended for swimming or recreational swimming, including underground and aboveground structures, and includes non-portable spas, spas, portable spas and wading pools. “Private Residential Pool” means any pool or spa located on private residential property under the control of the owner or tenant, the use of which is limited to swimming or bathing by family members of the owner or tenant or their guests. “Owner” means any person who owns, rents or intends to own or rent a public swimming pool.

The term “Commission” refers to the Consumer Product Safety Commission.
