I`m not used to doing politics on social media, but this time I can`t let it pass.

Having lived (in marital bliss) with a criminal lawyer for 20+ years, I can assure you that: 1) I have never met a criminal lawyer who is a “big cat” 2) They are not striking for their individual wealth, but to save our broken criminal justice system. Everyone has the right to justice. It is the backbone of a human society. However, 60,000 criminal cases are now awaiting trial in the Crown Court. The average time it takes to close a case is now 708 days. For almost 2 years, victims, witnesses and accused have had to put their lives on hold. Cases of rape and sexual assault are among the longest waiting. Last week, my husband defended an attempted murder. The trial had waited 5 years to be heard.

The wait took a toll on the victim`s mental health. This cannot be acceptable. Why is this happening? Simply put, this is due to years of cuts to legal aid. Wages and salaries have not increased in 20 years, representing a 28 per cent decline in real incomes. As a result, criminal lawyers have little choice and leave the profession. In the last 5 years, a quarter of them have left. Some cases are no longer financially viable. Lawyers are self-employed and, after factoring into clerks` fees, expenses and other independent costs, the rate may be lower than minimum wage. At the lower end of the scale, the Bar Council estimated in 2019/2020 that a criminal justice lawyer earned less than £13,000 in the first two years of practice. And don`t let me start with what it will do for diversity or wellness at the bar.

I know we all work hard, but they work really hard. Ridiculously late at night and weekends is the norm. The importance of work-life balance doesn`t seem to apply to them. It`s not just the hours, but also the pressure of work. A difficult test consumes every thought. Because the future of their clients, victims and society depends on their good work. Where does that leave us? I have always been proud to live in the UK, where everyone had access to free health and justice services. I know the money is tight right now, but the state of the criminal bar can no longer be ignored. The system is at its limits. Without investment, it will be a completely different story in 5-10 years.
